ZPP Position on Territorial Supply Constraints (TSC)

  • ZPP supports efforts to strengthen the Single Market and remove unjustified barriers to the cross-border movement of goods.
  • Differences in products, packaging, prices or distribution should not automatically be considered unjustified TSCs.
  • Before introducing new regulations, TSCs should be clearly defined and
a comprehensive impact assessment should be conducted.
  • EU action should prioritise the harmonisation of national requirements, more effective enforcement of existing rules and reducing regulatory fragmentation.

The European Single Market remains one of the most important achievements of the European Union’s economic integration. The free movement of goods between Member States is of fundamental importance for the competitiveness of European businesses, the efficiency of supply chains, and the availability of products to consumers.

At the same time, businesses operating in the European market face significant differences in the conditions for conducting business across individual Member States. This applies in particular to requirements concerning labelling and packaging, language, consumer information, deposit return systems, extended producer responsibility, taxation, environmental requirements, and other national regulations.

In the view of the Union of Entrepreneurs and Employers (ZPP), phenomena referred to as Territorial Supply Constraints (TSC) should be analysed taking into account the actual reasons for differences in the availability of products, their prices, distribution methods, and commercial terms between Member States. Differences in products, packaging, prices, or distribution models should not, in themselves, be automatically equated with unjustified restrictions on cross-border trade.
